This Subscription Services Agreement (the “Agreement”) constitutes a legal, binding agreement between Hindmarsh Productions including Performer Websites and the client identified in the initial sign up form (“Client”) for certain archiving or other Services (as defined in Section 1.1) and states the terms upon which Hindmarsh Productions including Performer Websites provides such Services to Client. The “Effective Date” of the Agreement shall be the date upon which the Client first executes the order form for Services (“Order Form”). By processing the initial sign up form and entering payment details, Client agrees to the terms of this Agreement; provided that, to the extent of any conflicting term, the Order Form shall supersede this Agreement solely with respect to the conflicting term.

1. Services
1.1 Hindmarsh Productions including Performer Websites will provide, and hereby grants Client the limited, non-exclusive, non-sublicensable right to access and use their Performer Website for promotion and distribution without restriction. Hindmarsh Productions including Performer Websites may modify the Services and the Service Descriptions from time to time, provided that such modifications do not materially adversely affect the Services.

1.2 Hindmarsh Productions including Performer Websites will deliver the finished website to the Client upon completion of the initial build and it is then up to the Client to provide updates via info@performerwebsites.com only.

2. Fees
2.1 Payment is taken during the first Order Form transaction and it is agreed that the client will make a minimum of 12 reoccurring payments before the subscription can be cancelled. If the Client is paying yearly, it is agreed that the client cannot request a refund or partial refund during the first year of the service.

2.2 The Client authorizes Hindmarsh Productions including Performer Websites to send instructions to the financial institution that issued the card provided by the Client to take payments from in accordance with the terms of the agreement stated above.
